WYCOMBE MP Steve Baker told the House of Commons this afternoon that an NHS boss has threatened him with legal action.

Mr Baker said he got the warning after he raised the prospect that the trust in charge of Bucks' hospitals may be liable for corporate manslaughter.

He revealed he has sought legal advice about taking the health trust to court and cited two recent cases.

But NHS chiefs have reacted with shock at his actions.

Edward Maitland died from respirational pneumonia at Wycombe Hospital as a result of being fed solids when he should not have been, an inquest found. Paul Ryan, who needed a leg amputation, faced a nine hour A&E wait at Stoke Mandeville in January and died a few days later, succumbing to peripheral vascular disease.

He said of the lawyers' advice to him regarding Mr Maitland: "They explained that in this case it may, at the preliminary stage, it may be that there is a case to answer for corporate manslaughter and liability for gross negligence manslaughter may well be attributable to one or more individual employees at the hospital.

"I don't want people to be prosecuted unnecessarily, I don't want to see taxpayers money wasted, but I want to see accountability. I believe that in the end courts provide that crucial accountability.

"I believe the court should be the ultimate way of sanctioning the NHS."

A recent Government report agrees, he said.

Wycombe Superintendent Gilbert Houlla has been briefed and the family has been passed the details of the lawyer's opinion.

He explained the case of Mr Ryan to MPs after his story was in last week's BFP.

Mr Baker told the commons: "Unfortunately this plays right into the publics fear. In Wycombe we lost A&E in 2005, we've recently lost our Emergency Medical Centre.

"We've just had two very similar repeat occurrences of the minor injuries unit failing to refer people across the car park to the excellent cardiovascular and stroke unit.

"We've had an enormous range of little problems. The little 85 year-old lady with dementia sent home at 2am in just her hospital gown. This cannot go on.

"The public's concerns are justified."

Then, Mr Baker launched an attack on management of the hospitals.

He said: "Finally I make a point on transparency. Yesterday I spoke to Anne Eden, the chief executive of the hospitals' trust and I'm not going to put on record the whole content of the conversation.

"But when I said I intended to raise this issue of corporate manslaughter, admittedly on the radio this morning, I was told in turn that to protect the reputation of the Bucks trust legal action would be sought.

"This is a matter of public interest raised by an MP in good faith. To be fair she was talking about radio. But I've had to rely on privilege to protect myself from being sued on this matter. It's not acceptable that such a matter should have to come to a MP to rely on privilege.

"It really is time for proper accountability and that must includes the court."

Bucks Healthcare NHS Trust has released the following statement.

It read: "“Buckinghamshire Healthcare NHS Trust is saddened and shocked by Steve Baker’s comments in the House today.

"We have strived to have an open and honest dialogue with all our MPs over recent years and are sorry if Steve does not feel that this has been the case and has used parliamentary privilege as a means to raise his concerns.

"We strongly encourage Steve or any other individual to contact us directly with any concerns, particularly those referred to today in the House, as we continuously strive to offer the best quality of care to our patients.”

Well Well Well Steve - it seems as if we finally share something in common because I was also threatened with legal action in the past by a senior manager!

To the likes of Anne Eden her job is purely business - meeting "targets", "saving" money, etc. They play at "business". It is a game. The public don't figure in the equation at all. If someone dies or has a very bad experience it is just a case of "whoops, sorry" to the likes of her.

One way to save money in the Health Service is to get rid of the plethora of different agencies and suits who just justify their own existence by making work for themselves.

I do not believe you are justify your salary.
I do not believe that you do a good job.
I do not believe that you care enough about people or patients.

Bloody well done Steve Baker for bringing to the Nations notice that not only Stafford executives but even here in Buckinghamshire the senior management are un-accountable. That they are allowed to use public (taxpayers) monies to threaten legal action against a Member of Parliament by making the Statement “to protect the reputation of the Bucks trust legal action would be sought.”
Does this not prove that Anne Eden and her board are GUILTY of the accusations levied against her and the Buckinghamshire Trust has total substance.
Time and time again she as CEO of the Trust have let us the people of Buckinghamshire down, she and her mismanagement are now under investigation. The quicker she is given the boot together with the rest of the board that prop up this failing Trust the better for us all.
I am reminded of a KING many years ago who said “Will no one rid us of this un-accountable Anne Eden the CEO” of Buckinghamshire’s failing Trust
I predict that she will get a large pay off when she finally gets the sack, funded by taxpayer’s money.
IT WILL BE WORTH IT!
Go ahead Steve Baker and accuse her of overseeing Corporate Manslaughter during her watch. Anne Eden does not have a leg to stand on.

I would finally point out that under Anne Edens watch the Trust have since 2008 attempted to obtain Foundation Status, Anne Eden has FAILED with every application and the last application has been suspended at her request, because they have no hope of approval and they do not want the record to show another rejection.

Well Mr Baker may be making himself "look good" by making profound statements that involve legal action. Pity he has not been more outspoken and active before now in getting A & E re instated at Wycombe and improving the minor injuries and out of hours service currently operating there. Stoke Mandeville cannot cope, our current health facilities are a shambles and Baker starts spouting about legal action. Do your job Mr Baker, sort out the real mess. If you are talking about wasting tax payers money it is you who are a drain on our money - you are achieving nothing. Get our health care necessities back to Wycombe hospital and start doing a proper job. Playing the big "I am" about corporate manslaughter is failing to address the real problem. If you fail to address the real problem then you are part of the problem and we are wasting our tax payers money on you. Go earn your keep.

It is not only the NHS that employ these legal silencing tactics in an attempt to cover up wrong doings.

I would make a comment but would be instantly threatened with legal action if I dare mention a matter that should be in the Public Interest.

I would assume the real agenda is to focus on corporate manslaughter which in turn takes attention away from the real agenda of total privatisation.
It was Mr Blairs government who in opposition along with Prescott's support tabled the new law. It was one of the first things that they did, however even after Potters Bar and the Yorkshire train disasters not one person has ever been convicted of corporate manslaughter.

I APPLAUD Mr. Baker for having the moral strength and fortitude to stand his ground. He's done a good job on other matters financial, and we need more like him.

Our son is currently in hospital in Hillingdon, who are doing an absolutely appalling job of sorting his health out. Perhaps Mr. Baker's actions and stance will inspire the MP for Hillingdon to take them on!

Anne Eden is a disgrace. I agree with some of the comments above. She is just moving money and people around without the slightest thought of the customer/patient. If she was running a business she have been fired long ago, because she is in the public sector she is protected by layers of safeguards for her personally unlike the patients. She is totally unaccountable like the rest of the trust a **** disgrace.

Steve Baker should be taken to court for impersonating an MP that cares about his constituent and the people who live in it.
He is nothing more than a laughing stock, lining his already well lined pockets.
If he really cared about us he would never had let the closure of the main parts of Wycombe hospital close.

Are you on this planet Robert M? Why should Steve Baker be taken to court for impersonation, He is an MP and, he cares about his constituents. He has fought for the reopening of services at High Wycombe, He has also raised it Many times in the House of commons. He has even had meetings with the previous Health Secretary. That you should accuse him of lining his pocket, where is your proof for such a stupid statement?
You should be venting your spleen at Anne Eden the CEO of the Hospital Trust, she and the PCT are the culprits for the closures. Get your facts and statements right as you are only making yourself look silly.

I personally do not like him,what his party stand for, or any of the conservative policies.

Steve Baker has consistently worked hard for Wycombe people especially
in his opposiiton to the changes in local health provision.
This coalition may not be perfect but they have been handed a poisoned chalice by the legacies of tony "evil eyes" blair - gordon "bigot" brown and the labour regimes of 1997-2010 - and the current nhs woes are just a part of their twisted legacy of failure and deceit.
