The owner of a wine bar in Princes Risborough has argued that a “restrictive covenant” preventing them from using their outside space will affect their trade over the summer months if it is not removed.

Dukes Wine Bar, in Duke Street, is currently not allowed to use their rear outside area for smoking or the consumption of alcohol, in order to protect nearby residents from noise and disruption.

The restriction was put in place when the bar was granted planning permission in August last year.

An application to remove the condition was submitted to Wycombe District Council on behalf of the owner on May 9, arguing that the use of the space is “necessary” for the bar to increase business during the summer months.

Town Planner Louise Hinsley from NextPhase Development, who put the application in on behalf of the owner, said in a supporting statement: “The existing condition prevents trade during the summer months and therefore has the potential to damage the socio- economy of the local area... The use of the rear outside area is deemed necessary in order for the establishment to be able to increase trade during the summer months.”  

The report also argues that the nearest flat window is at least 15 metres from the new bar; meaning disruption to residents would be minimal.

The application is currently being considered by Wycombe District Council.
