Swan killing case dropped

THE TRIAL of three Chesham men accused of killing 29 swans has been abandoned after crucial evidence was lost from a police station.

Stephen Barrett, 38, Marcus Walker, 51, and Darren Walker, 47, pleaded not guilty to killing the birds and were due to appear at Bedford Magistrates Court today.

However, the case has had to be dropped after the ammunition allegedly used to kill the animals was lost from Greyfriars Police Station in Bedford.

The swans were found in a mass grave at Radwell in Bedfordshire last October. They had all been shot.

Also found in the pit were a marsh harrier and a grey heron.

A joint statement has been released by Detective Chief Superintendent Andrew Richer of Bedfordshire Police and Chief Crown Prosecutor Richard Newcombe.

It reads: "This case was significant and was taken seriously by police, RSPB and prosecutors.

"However the loss of ammunition from Greyfriars Police Station means it is believed that there is no longer a realistic prospect of conviction.

"A full review of the case will be conducted in conjunction with the RSPB who welcome this approach."

The Royal Society for the Protection of Birds had helped to bring the case to court.

Ian West, head of investigations at the RSPB said: "We are bitterly disappointed and feel we have no choice but to make a formal complaint to Bedfordshire Police about the way this case has been handled.

Mute swans are protected birds. Anyone found guilty of killing them faces a fine of up to £5,000 or up to six months in prison.

bloody typical for the police to lose vital evidence, how the hell can you lose stuff like that bunch of twats, sad that those poor birds dont get any justice from these thugs someone should go and put a shot gun to their heads

This is criminal neglect by the Police and an investigation should be made to see who was at fault. I'm in no way undermining the severity of the case but if this was for murder against people then this would be a massive scandal. Thought Police procedures are in place were people were accountable. You can’t just loose evidence, can you.

You shouldn't but obviously you can. Not that I'm excusing them, but a bullet is pretty small and could easily fall out

Fall out of what? A sealed evidence bag? More likely it got 'lost' somewhere between the forensics labs and the police station. I hope someone is found neglegant and repremanded.

At last BFP catches up with our local news!

This was first reported on the BBC website on Friday and I emailed BFP to say that it should be on this site.

The BFP should realise that news happens 24 hours a day, 7 days a week, not just weekdays!!!

Whatever happened to innocent until proven guilty? Everyone is only too quick to point the finger and the media just sensationalise everything. What about the fact (not mentioned) that the police never checked any alibis? What about the fact that on the day in question there were six people together at these Lakes: three were charged and three were not even questioned . Never quite as straightforward as it seems, is it?

The fact that the police can 'lose' important evidence against these 'people', is all probably because they are way too busy sneaking around and hiding in their mobile speed vans.

Shame on you!
