A man convicted of wearing clothes likely to deceive people into thinking he was a policeman has had his conviction overturned.

Darren Emanuel, from Chalfont St Giles, was stopped when commuting to work on a decommissioned ex-police motorbike while wearing a high-visibility jacket saying “Polite notice: think bike” on the back.

Hendon Magistrates acknowledged there was no intention by Mr Emanuel to deceive anyone, but convicted him under the Police Act 1996 on the basis that the jacket resembled police uniform.

He was conditionally discharged.

The Crown Court then threw out the conviction shortly afterwards in February last year.

Mr Emanuel’s successful appeal was not reported at the time.

Mr Emanuel has told the Bucks Free Press that he has started a legal claim against the police on grounds of ‘malicious prosecution’ and ‘misfeasance in public office’.
