A LOCAL man who set up a takeaway business in his back garden may have to shut up shop after the council refused him permission to operate.

Bucks Council recently rejected Mr Raqib Hussain’s retrospective application for a dessert business at 42 Mill End Road, a residential property in High Wycombe.

His application, submitted between September and November 2021, requested permission to convert a storage area in the back garden of the residential property to a dessert takeaway.

However, it appears the takeaway actually started operating in November 2020, according to council documents.

It also appears to have had one full-time employee, offered delivery and kerb-site collections, and held opening hours between 5pm-11pm most days.

But the council found the business to be “wholly inappropriate” in the area, that it would “adversely affect” neighbours, and that it would “exacerbate” existing parking problems.

However, Mr Shoaib Hussain at number 40 Mill End Road said he had “no issues with this application”.

“The retrospective development incorporates a takeaway business within the rear garden area of No. 42 Mill End Road,” according to the council. “A takeaway in this location is considered to be wholly inappropriate.

“Takeaways are aimed to be located within commercial, or mixed-used areas where a variety of uses are recognised in an area.

“However, in this case, the retrospective development features a takeaway use within a rear garden area, in a residential settlement.

“The development is considered to be wholly at odds with the prevailing character of the area, which would be further intensified as the business grows.

“A takeaway in this residential garden is considered to adversely affect the amenities of neighbouring properties through noise and odour pollution.

“It has been specified within the application details that the service is in the form of deliveries, with kerb-side collection being available for customers.

“Given the parking stress already evident on the local highway network it is considered that a takeaway use in this area would only exacerbate the problem.”

A Bucks Council spokesman: "We can confirm we have served an enforcement notice on this site, requiring that the business use is ceased."
