A man has been charged over a thousand pounds for failing to take precautions against a third party fly tipping his waste.

Darren Wiltshire, 44, from Hemel Hempstead in Hertfordshire, pleaded guilty to failing in his duty of care when he was found to be implicated in the illegal dumping of waste in a lay-by on the A412 Denham Road in Iver in October 2022.

Buckinghamshire Council said that Mr Wiltshire had "initially tried to evade the law" after the waste, which he had been legitimately paid to dispose of by a provider, was passed onto a third party without undergoing due diligence checks.

Officers found that he had “failed to check if the new owner of the van was a registered waste carrier” and had “taken no precautions to prevent or deter him from fly tipping the waste”.

Appearing at High Wycombe Magistrates’ Court on May 24, 2023, Mr Wiltshire was fined £603 for failing in his duty of care alongside clean-up and prosecution costs of £1,000 and a victim surcharge of £41.

Gareth Williams, cabinet member for climate change and environment, said the case “highlighted the need to identify and check the credentials of people who take your waste away”.

Adding: “Businesses should keep accurate records of such transfers to create a paper trail. On this occasion, the paper trail supported the waste producer and led our investigators to the waste carrier.

“When the waste carrier could not also show his due diligence, the responsibility remained with him, leading to a successful prosecution.”
